01 — DEFINITIONS

Definitions

  • "Saaph.in", "we", "us" — Saaph.in and its operators.
  • "Service" — saaph.in, its scanning tools, dashboard, and associated software.
  • "User", "you" — any individual who accesses or uses the Service.
  • "DPDP Act" — the Digital Personal Data Protection Act, 2023 (India).
  • "Erasure Request" — a written request invoking the right to erasure under Section 12 of the DPDP Act.
  • "Data Fiduciary" — any company or platform to which an Erasure Request is directed.
  • "Scan" — the privacy exposure analysis performed by our Service.
02 — ACCEPTANCE

Acceptance of Terms

By accessing or using Saaph.in, you confirm you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Service. These Terms apply to all users including Free and paid plan subscribers.

03 — WHAT WE DO

Nature of Our Services

Saaph.in provides a technology platform that:

  • Analyses your likely data exposure across Indian platforms based on your provided details.
  • Prepares legally formatted Erasure Requests under the DPDP Act 2023.
  • Provides tools to send, track, and monitor the status of those requests.
  • Performs periodic re-scans (every 15 days on Pro plans) and notifies you of changes.

Important

Our scans are analytical estimations based on known platform data patterns. We do not conduct real-time scraping of all platform databases. Actual data presence may differ from results.

04 — ERASURE REQUESTS

DPDP Act Email Requests — Scope & Limitations

This section governs what we do and do not do regarding DPDP removal emails.

4.1 What we do

Saaph.in prepares a legally formatted Erasure Request citing Section 12 of the DPDP Act, addressed to the Data Protection Officer of the relevant platform, including your personal details as provided. Each request is assigned a unique Tracking ID and logged in your dashboard with a timestamp.

4.2 How the email is sent

The Erasure Request is sent by you, from your own email account, using the "Send from My Email" button. Saaph.in opens your email client with the request pre-filled via the mailto: protocol. You click Send. Saaph.in does not send the email on your behalf unless you have subscribed to an automated sending feature and granted explicit authorisation.

4.3 What we track

When you click "Send from My Email," we record: the send timestamp, the platform and DPO address, a unique Tracking ID, and a 90-day compliance deadline. This is your evidence that a request was initiated. It does not constitute legal proof of delivery or receipt.

4.4 What we cannot guarantee

Saaph.in cannot and does not guarantee:

  • That the email is delivered to or received by the Data Fiduciary.
  • That the Data Fiduciary will respond within 90 days or at all.
  • That your data will be removed as a result of the request.
  • That DPO email addresses in our database are current or monitored.

If a company ignores your request

Under the DPDP Act 2023, you may file a complaint with the Data Protection Board of India once constituted. Saaph.in is not a legal representative and cannot file complaints on your behalf.

05 — THIRD PARTIES

No Guarantee of Compliance by Third Parties

Saaph.in has no contractual or legal relationship with any third-party platform we scan or to which Erasure Requests are directed. We are an independent technology service. Whether a company complies depends entirely on that company. Saaph.in bears no responsibility for the actions or inactions of any third-party Data Fiduciary.

06 — OUR ROLE

Our Role — Service Provider, Not Legal Agent

Saaph.in is a technology service provider. We are not a law firm, your legal representative, or a Data Protection Officer acting in any official capacity. Nothing in these Terms constitutes legal advice. We strongly recommend consulting a qualified legal professional for legal representation regarding data privacy matters.

Saaph.in provides a documented record of requests sent, with timestamps and Tracking IDs. This record may be useful as supporting evidence in formal proceedings, but we make no representations as to its legal admissibility.

07 — DATA WE PROCESS

Data We Collect and Process

To provide the Service, we collect: your name, phone, email, city; additional identities in your Digital Profile; scan results and removal logs; and account credentials (hashed). We do not sell your personal data for marketing. See our Privacy Policy for full details.

Free plan

All scan data is stored in your browser's local storage. Clearing browser data will erase it. Registered Pro users have data backed up to our secure servers.

08 — SCAN ACCURACY

Scan Results and Accuracy

Scan results are illustrative estimations based on known exposure patterns. They are not real-time and may not reflect all platforms, recent removals, or data added after our last index update. Results should not be used as the sole basis for any legal proceeding.

09 — BILLING

Subscription, Billing & Cancellation

  • Monthly plans — Auto-renew monthly. Cancel anytime before the next billing date.
  • Annual plans — Billed once yearly at the discounted rate. No partial refunds for unused months.
  • Free tier — No credit card required to scan. A paid plan is required to send removal requests.
  • Refunds — Available within 7 days of purchase if no removal requests have been sent. See the Refund Policy.
10 — WARRANTIES

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that any Erasure Request will result in data removal from any platform.

11 — LIABILITY

Limitation of Liability

To the maximum extent permitted by law, Saaph.in shall not be liable for: any failure by a Data Fiduciary to comply with an Erasure Request; any harm arising from continued data availability despite a request; indirect or consequential damages; or data loss from browser clearing or account termination.

Our total liability for direct damages shall not exceed the total amount paid by you in the 3 months preceding the claim.

Saaph.in gives you a tracked record that a DPDP Act Erasure Request was prepared and that you sent it. We are not responsible for whether any company acts on the request, removes your data, or responds at all. Our responsibility ends at providing the tools and the record.

13 — GOVERNING LAW

Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.

14 — CHANGES

Changes to These Terms

We may update these Terms periodically. Material changes will be communicated to registered users by email. Continued use after changes constitutes acceptance.
